Our Booking and Scheduling Application with many features (the "Service") is provided by BLUESOFT SOFTWARE DEVELOPMENT SERVICES under the brand name ZIQ APPS, a Philippines based company, and is available worldwide to those who agree to these Terms. By accessing or using our website and services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our Service. 7

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. 710
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUESOFT SOFTWARE DEVELOPMENT SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; OR (D) ANY BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS. 710
In no event shall our aggregate liability exceed the amount paid by you, if any, for accessing the Service during the twelve (12) months immediately preceding the event giving rise to the claim. 7
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. 7
These Terms shall be governed by and construed in accordance with the laws of the Philippines without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms or your use of the Service shall be resolved exclusively in the appropriate courts in the Philippines. 710
You agree to indemnify, defend, and hold harmless BLUESOFT SOFTWARE DEVELOPMENT SERVICES and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms. 7
